Can a medical practice use the Meta pixel or Google Analytics on its website?
On a blog post, arguably, after the June 2024 court ruling. On any page where a patient can book, request a consult, or log in, no, unless the vendor has signed a business associate agreement, which Meta and Google do not for those tools.
In American Hospital Association v. Becerra the court vacated HHS guidance about IP addresses on public condition pages; it left the rest intact. Settlements over pixels on booking flows have run $6.6 million to $18.4 million.
